Overview

This website, akicktion.com, is operated by Akicktion ("we", "us", "our"), an apparel brand based in Albany, Georgia. By visiting the site or buying from us, you agree to these Terms of Service ("Terms"), along with our Privacy policy, Refund policy and Shipping policy, which are part of these Terms. If you don't agree, please don't use the site.

Our store is hosted on Shopify, which provides the online platform we use to sell our products to you.

1. Using the site

You must be at least the age of majority where you live, or have a parent or guardian's permission, to place an order. You agree not to use the site for any unlawful purpose, to interfere with its security or operation, or to upload anything harmful. We may refuse service to anyone, for any lawful reason, at any time.

2. Products and orders

Our products are printed to order. We try to show colors and prints as accurately as possible, but screens vary and small differences in color, print placement and sizing are normal for printed apparel. Product descriptions, availability and prices may change without notice. We may limit quantities, or cancel and refund any order, including if a price or product listing contains an error or we suspect fraud.

3. Prices and payment

Prices are in US dollars unless shown otherwise. Shipping costs and any applicable taxes are shown at checkout. You agree to provide accurate, current purchase and account information and to pay all charges at the prices in effect when you order.

4. Shipping, returns and refunds

Shipping is covered by our Shipping policy, and returns and refunds by our Refund policy. Risk of loss passes to you when the item is handed to the carrier, but we'll still help with lost or damaged packages as described in those policies.

5. Intellectual property

All designs, artwork, logos (including the Akicktion name, the AK mark and the shoelace script), text, photos and other content on this site belong to Akicktion or its licensors and are protected by copyright and trademark law. Buying a product doesn't give you any right to copy, reproduce or resell our designs. You may not use our content without our written permission.

6. Your submissions

If you send us comments, ideas, reviews or other material, you grant us permission to use them without restriction or payment, and you confirm they don't violate anyone's rights.

7. Third-party links and services

The site may link to or use third-party services (such as payment processors, our print and fulfillment partner, and social media). We aren't responsible for third-party sites or services, and your use of them is subject to their own terms.

8. Disclaimer

The site and our products are provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, except as stated in our Refund policy.

9. Limitation of liability

To the fullest extent allowed by law, Akicktion and its owners, team members and partners won't be liable for any indirect, incidental, special or consequential damages arising from your use of the site or our products. Our total liability for any claim related to an order won't exceed the amount you paid for that order.

10. Indemnification

You agree to indemnify and hold harmless Akicktion and its owners, team members and partners from any claims, losses or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your violation of any law or third-party right.

11. Governing law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Georgia, and you consent to their jurisdiction, unless the law where you live requires otherwise.

12. Changes to these Terms

We may update these Terms at any time by posting the new version on this page. Continuing to use the site after changes are posted means you accept them.

13. Severability

If any part of these Terms is found unenforceable, the rest stays in effect.
